Cancellation for the Foreigner's Work Permit of the People’s Republic of China
Required Materials
1. The cancellation application form for permission for foreigners to work in China shall be filled out online and then printed out, signed by the applicant, and uploaded to the system with the official seal of the employer or the official seal of the authorized department of the employer. Original (1 electronic/paper copy).
2. Proof of cancellation of employment, termination of contract or other reasons related to the cancellation. Cancellation of the employment relationship and termination of the contract require the signatures of both parties. If the applicant leaves his/her job on his/her own or the employer is unable to contact the applicant, the employer shall submit additional notes on the cancellation. Original (1 electronic/paper copy).
3. Guidelines for Renewal of Foreigner's Work Permit Including the Foreign Expert Permit and the Foreigner's Work Permit that are currently in force. Original (1 electronic/card copy)
Material Standards
1. All original paper documents and Chinese translations shall be uploaded electronically in colors into the application system.
2. All supporting documents that are not in Chinese shall be translated into Chinese and affixed with the official seal of the employer (except for passport or international travel document).
3. All original documents shall be submitted to the reception window for verification. No paper documents are required for verification of foreign talents qualified in related talent programs.
Notes:
1. If the validity period of a Foreigner's Work Permit to Come in China expires without renewal, it shall be automatically cancelled; if it is revoked or withdrawn in accordance with law, or if the permit document is invalidated in accordance with law, it shall be cancelled by the decision-making authority. In case of death or incapacity of the applicant or premature termination of the contract or employment relationship, the employer shall apply to the decision-making authority for cancellation within 10 working days from the date of occurrence of such event. In the event of termination by the employer, the applicant may apply to the decision-making authority for cancellation of the work permit.
2. If the applicant quits the job without permission, the employer shall submit the original public letter (with an official seal) and the original newspaper announcing such event. If the employer is terminated in accordance with the law, the "Application Form for Cancellation of Foreigner's Work Permit in China" may be submitted without the official seal of the employer, and the employer shall provide related supporting documents (such as the original and copy of the cancellation certificate of the employer issued by the industrial and commercial department), the letter of clarification of the applicant on the cancellation of the permit (with the official seal) and the Foreigner's Work Permit.
3. If the Foreigner's Work Permit in China has been cancelled, a certificate of cancellation shall be issued by the decision-making authority upon application. If the work permit expires and is automatically cancelled by the system, the decision-making authority will not issue the certificate of cancellation of the permit.
4. After passing the online pre-qualification, please make an appointment in the system, and bring the appointment certificate and related materials to the site for further procedures. No appointment is required for foreign high-end talents (Type A), who can bring related documents directly to the site for processing.
